This auto accident case arose out of a motor vehicle accident (MVA) which occurred in Buckingham Township, Bucks County, Pennsylvania (PA), when the plaintiff woman driver, was driving on her way to school as a school teacher.
The conduct of the Defendant driver in causing the accident was shocking. While under the influence of marijuana or pot, she drove straight at a right hand curve in the road and crossed over the center lane of Route 202 and crashed into our client’s vehicle at a high rate of speed head on. Our client had no opportunity to escape the on coming vehicle. With nowhere to turn or get her car out of the way, our client was struck head on by the other vehicle. The defendant or reckless driver was convicted of aggravated assault by vehicle with driving under the influence (DUI) for which she is currently incarcerated and serving an 11 1/2 months to 23 month sentence.
Due to the force of the impact, our client suffered a fractured pelvis, fractured knee, fractured skull with a traumatic concussion brain injury, multiple fractured ribs, fractured arms, radial nerve injury and neuropathy, cervical C6 fracture and a mesenteric artery collapse.
Because of a delay in obtaining policy limits of $1.35 million, counsel threatened a bad faith action against the Defendant’s insurance carrier. A factor in expediting settlement was the potential for a punitive damages award against the Defendant-driver. Attorney for Plaintiff and experienced Philadelphia motor vehicle accident lawyer, Scott Bennett, was able to obtain all of the insurance coverage ($1.25 million liability coverage and $100,000.00 of underinsurance coverage).
