How many times this year have you heard on the news about a car, bus or truck losing control and crashing into a home, school or place of business? It happens almost daily.
Just recently, in Center City Philadelphia, a car crashed into a Burger King at 8th and Walnut streets. Not only did the car destroy bricks and glass, it injured 7 diners, including the driver. Some of the diners are in critical condition and others suffered lacerations. But all had to suffer from some emotional distress. Even if it was an “accident,” should injured patrons, who were in the Burger King at the time the car came crashing through the wall, pay for their injuries?
Right now, in this most recent auto vs. building case, it does not appear that alcohol, drugs, texting, sleep deprivation or speed played a role in the accident. The driver of the car that drove through the wall of the Burger King was 85 years old and driving a car that was manufactured years ago.
