Earlier today a jury in Delaware County, Pennsylvania, awarded approximately $3.75 million to a medical malpractice victim represented by Beasley Firm trial lawyer Dion Rassias. With delay damages and interest, the total verdict amount to help care for this little girl who has cerebral palsy (CP) is just shy of $5 million.
The Beasley Firm has fought on the family’s behalf for several years. This case was initially tried in front of a jury two years ago but, due to an error in how the judge instructed the jury, the jury found for the defense. We immediately filed an appeal; Barbara Axelrod, one of our experienced appellant attorneys, persuaded the Superior Court that the trial judge had made a serious error, and the case was remanded for a new trial.
During this two week trial, Dion Rassias was able to successfully prove that the first time pregnant mother’s swelling and complaints of headache and abdominal pain warranted further evaluation by the obstetrician (OB/GYN). Instead of being evaluated to make sure the mother’s blood pressure at that time during the pregnancy was acceptable, the OB doctor just told the mother over the phone to take Tylenol.
We do not know if the mother was even able to take the Tylenol or not – the open bottle was beside her body when she was found unconscious on her kitchen floor after suffering a seizure and stroke due to undiagnosed and untreated eclampsia. The mother was immediately transported to the hospital for an emergency cesarean section (CS) but, by that point, the baby girl she was carrying had already suffered from a lack of oxygen. The hypoxia caused damage to the child’s brain, and she now has cerebral palsy.
The mother never filed a potential lawsuit on her behalf regarding the stroke she suffered and her residual deficits. She only cared about her daughter, her deficits, her CP and her future medical expenses. The little girl needs care, and now she should be able to get it.
