Due to backyard space issues, community regulations, city ordinances or the belief that some pools are safer than others, many homeowners, property owners, or associations will have above-the-ground pools instead of in-ground pools. Unfortunately, above-ground pools are not any safer than in-ground pools.
Above-ground pools have injury or drowning risks that permanent pools do not. Unlike in-ground pool owners that have many safety regulations to abide by such as fences, locking gates, alarms or pool covers, above-ground pool owners do not. Once a small child can gain access to a free standing pool, they can easily drown because there is no baby pool area but rather one water depth that can be over the child’s head. Unless the child knows how to swim, or tread water, their head will become submerged under water that can lead to a lack of oxygen to the brain, brain damage, or a drowning death. Above the ground pool owners must make sure they have a detachable ladder or locking gate to prevent a child’s access to the ladder or pool.
Because above-ground pools are usually only four or five feet deep, anyone who dives into the pool is at risk of striking their head on the bottom of the pool causing, spinal cord injuries, paralysis, quadriplegia, paraplegia or a diving related death. Homeowners, property owners, or parents who have an above-ground pool need to take the necessary precautions to prevent an accidental drowning or catastrophic injury to any swimmer.
If you or someone you love has suffered an injury, drowning or death in a backyard swimming pool, you may be able to file a claim for premises liability if the pool that caused you or a loved one’s injury or death was lacking required safety devices or if poor pool maintenance caused or contributed to your injuries. You could also have a claim for product liability if you were not made aware of the safety hazards of the type of pool that caused your injuries.
