$135 Million Paid for Medical Malpractice Law Suits in Just One Year

by The Beasley Firm  |  January 19, 2012  |

Even though a monetary award will not return a person or their family back to the way their lives were before an accident or medical mistake, it can help them afford their current medical needs, treatments, and expenses.

In 2011, New York City paid out $135 million for medical negligence mistakes at its public hospitals. That was a 5% increase since 2010. For many patients, the medical malpractice mistakes caused catastrophic injuries or even death to a child.

Imagine how your life would be impacted if these hospital errors happened to you or a family member:

A 38 year old woman had a tooth abscess drained and the dentist failed to request a culture of the infected tissue to see what caused the infection and what was the appropriate antibiotic to put her on for the bacteria that caused the infection. Ten days later, she was rushed to the hospital because she was paralyzed from the neck down or a quadriplegic. She had a MRSA infection that infected her neck and spine. She was awarded $8 million to help pay for her life-long medical costs.
A 10 year-old child was having an asthma attack and could not breathe at all. Her breathing was so bad that she had to be put on a ventilator or breathing machine. The doctor ordered the ventilator to be set to give the little girl 40 breaths per minute instead of 8 to 10 breaths per minute as per protocol for a small child. Three hours later, she died because her lungs were “blown out”. A jury awarded the parents $3.5 million for the pain and suffering they endured and additional money to help pay for their funeral expenses to bury their little girl.
A 43 year-old man entered a triage area of a hospital complaining of trouble seeing out of his one eye, which could be a sign of an impending stroke. Instead of being properly triaged and treated, he suffered a stroke that left him paralyzed and unable to speak clearly. He was awarded $5.5 million to pay for his medical costs and his lost income that caused a financial burden on his family.
Here at the Nationally known Beasley Law Firm, these are some of the catastrophically injured individuals and their families we were able to help:

A premature baby who suffered brain damage and amputation of his arm as a result of medical malpractice during a relatively minor heart surgery. The family was awarded $100 million, the largest medical malpractice verdict in Pennsylvania history, to assure that this baby can be taken care of the rest of his life.
This case was against the world famous cardiothoracic heart surgeon, William Norwood, M.D., who performed an unauthorized surgical procedure on a baby during surgery to repair Coarctation of the Aorta. That procedure rendering him severely brain damaged and in permanent need of lifelong care. We obtained this $55 million record setting verdict just weeks after being awarded the $100 million verdict.
An obstetrical negligence case which caused a mother to delivery her baby prematurely and immediately after birth, another doctor caring for the premature baby in the delivery room put the breathing tube into the baby’s esophagus instead of the lungs. Because the lungs were not receiving oxygen, the baby suffered from oxygen deprivation and permanent brain damage. The family was awarded $37 million to help care for their injured baby.
